Terms of Service

These Terms of Service ("Terms") govern your purchase and use of LERSER Secure (the "Software"), a digital software boilerplate. By purchasing or using the Software, you agree to be bound by these Terms.

1. License Grant

Subject to your payment of the applicable fees, we grant you a non-exclusive, non-transferable, and perpetual license to use the Software code for:

  • Personal projects.
  • Commercial projects and client work.

Restrictions: You are strictly prohibited from reselling, redistributing, sub-licensing, or sharing the Software as a standalone template, boilerplate, or starter kit, in its original or modified form.

2. "As-Is" Warranty & Security Disclaimer

The Software is provided "AS IS" and "AS AVAILABLE," without warranties of any kind, either express or implied, including but not limited to warranties of merchantability or fitness for a particular purpose.

LERSER Secure is a development tool. You acknowledge that you are solely responsible for:

  • The final implementation of the code.
  • Managing your environment variables and secrets (e.g., API keys).
  • Ensuring the security and compliance of any application built using the Software.

3. Limitation of Liability

To the maximum extent permitted by applicable law, the creators of LERSER Secure shall not be liable for any indirect, incidental, special, or consequential damages, including but not limited to: financial loss or loss of profits, data breaches or security vulnerabilities in your final implementation, or unanticipated API costs or usage spikes from third-party providers (e.g., OpenAI, Firebase).

Our total liability for any claim arising out of these Terms shall not exceed the amount paid by you for the Software.

4. Refund Policy

Due to the digital nature of LERSER Secure and the immediate delivery of the full source code, all sales are final. By accessing or downloading the software, you explicitly waive your right to a refund.

Exclusions & Technical Faults:

We offer refunds exclusively in cases where a verified technical defect exists within our original, unmodified source code that prevents the software from functioning as advertised.

What is NOT covered:

  • User Modifications: If you modify, delete, or alter the source code and the application crashes or fails, this is not grounds for a refund.
  • Third-Party Issues: Failure to correctly configure Firebase, Vercel, or API providers (OpenAI, Gemini, etc.) is the responsibility of the user.
  • Change of Mind: We do not offer refunds for accidental purchases or if the product no longer meets your specific project needs after the code has been accessed.

To request a technical review for a refund, you must provide logs and evidence of the fault in the original codebase.

5. Third-Party Services

The Software integrates with third-party services (e.g., Firebase, OpenAI). Your use of these services is subject to their respective terms and privacy policies. We are not responsible for any changes, outages, or costs associated with these third-party providers.

6. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction where the service provider operates, without regard to its conflict of law provisions.
